Terms of Service

These are the terms of service for Shomery ("Shomery", "we", "us", or "our"), operated from California, USA. By using Shomery, you agree to these terms. If you don't agree, please don't use the service.

We've written this in plain English on purpose. The full legal effect is the same as a more formal document, but you should be able to read it without a lawyer. If anything is unclear, email hello@shomery.com before you accept.


1. Who can use Shomery

You may use Shomery if:

You sign in to Shomery using your Google account through Google's OAuth flow. You're responsible for:

3. What Shomery does

Shomery watches your Gmail inbox for emails matching senders or domains you specify, generates short markdown summaries using artificial intelligence, and saves those summaries into a folder inside your own Google Drive. You can then read the feed in our web app and ask grounded questions across your archived summaries. Full details of what data we access and how we use it are in our Privacy Policy.

5. Your Gmail and Google Drive content

You own your Gmail content and the Shomery summaries stored in your Google Drive. We do not claim any ownership rights over the data we process on your behalf. By using Shomery, you give us a limited, non-exclusive license to access, process, and store this data only for the purpose of providing the service to you, as described in our Privacy Policy.

We're not responsible for the actions or decisions of these third parties, but we choose them carefully and they're subject to contractual data-handling restrictions described in our Privacy Policy.


8. Our intellectual property

The Shomery name, logo, software, and the look-and-feel of the service are owned by us. You may use the service for its intended purpose but you may not copy, modify, resell, or create derivative works of the Shomery software or branding without our written permission.

We may release portions of our codebase under open-source licenses from time to time. When we do, the license terms for those portions are stated in the relevant repository.


9. Service availability

We try to keep Shomery running reliably, but we don't guarantee uninterrupted access. The service may be unavailable due to maintenance, updates, third-party outages, or unforeseen issues. During the current pilot phase, the service is provided "as is" with no uptime guarantee.

We reserve the right to modify, suspend, or discontinue any part of the service at any time, with reasonable notice for material changes.

Shomery is provided "as is" and "as available", without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement. We do not warrant that:

11. Limitation of liability

To the maximum extent permitted by California law:

Some jurisdictions don't allow the limitation or exclusion of liability for certain damages, so portions of these limits may not apply to you.


12. Indemnification

You agree to defend and indemnify Shomery and its operators against any third-party claims arising out of (a) your use of the service in violation of these terms, (b) your violation of any law or third-party right, or (c) content you provide or process through the service that infringes someone else's rights.


13. Termination

You can stop using Shomery at any time by disconnecting it from your Google account and deleting your Shomery account.

We can terminate or suspend your access if you violate these terms or use the service in a way that puts the service, other users, or third parties at risk. We'll try to give reasonable notice unless the violation is severe.

The sections of these terms that by their nature should survive termination (intellectual property, disclaimers, limitations of liability, indemnification, governing law) will survive.


14. Changes to these terms

We may update these terms occasionally. When we make material changes, we'll notify you by email or through the service before the changes take effect. Continued use of Shomery after the effective date of new terms means you accept the new terms. If you don't accept, stop using the service before the changes take effect.


15. Governing law and dispute resolution

These terms are governed by the laws of the State of California, USA, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these terms or to Shomery will be resolved exclusively in the state or federal courts located in California, and you and we both consent to the personal jurisdiction of those courts.

Nothing in this section prevents either of us from seeking injunctive or equitable relief in a court of competent jurisdiction.
